Thornton signs Amicus Curiae brief to the United States Supreme Court

It’s not every day that North Dakota lawyers participate in litigation with the United States Supreme Court.  Fremstad Law’s Nick Thornton, however, just joined in amicus curiae (“friend of the court”) brief filed by almost 30 criminal defense associations asking the U.S. Supreme Court to address a critically important issue for all criminal defendants: the right to a fair and impartial jury.  The case is Lacaze v. Louisiana, No. 16-1125.  In his appeal, Lacaze argues the Supreme Court should set a more lenient standard for new trials in criminal cases when jurors do not honestly answer material questions posed to them in jury selection that would likely impact the outcome of the trial.  Currently, most courts apply a very high burden on defendants requesting a new trial from a civil case.
